This website is owned and operated by Chorus Dei & Orquestra. a free, non-profit, open and voluntary membership music ministry. These Terms set out the terms and conditions under which you may use our website and services offered by us. This site provides visitors with descriptions of the activity and artistic-historical profile of this musical group, as well as its mission and some of its supporters. The site offers public access to selected sounds and recorded images of the activities of the aforementioned choir and orchestra. The site also exclusively offers the group's members access to the sheet music bank in rehearsal kits for choristers and instrumental musicians, among other internal features intended only for members, such as instructions and vocal technique exercises. By accessing or using our service website, you are agreeing that you have read, understood and agree to be bound by these Terms.
Services provision:
Chorus Dei & Orquestra is a non-profit, voluntary association music ministry, founded in 2001 and directed since then by maestro David Wesley Silva, CPF. 093674148-11. The choir and orchestra have their activities headquartered at Centro Universitário Adventista (UNASP-HT) on the Hortolândia-SP campus, at Rua Pr. Hugo Gegenbauer, 265 – Pq. Ortolândia CEP 13184-010. The various activities are carried out weekly, following a calendar fed by invitations for presentations and certain break periods, marked as vacations and/or holidays.
Deadline for delivery of services:
To receive and participate in Chorus Dei's services, prior registration is required through the website www.chorusdei.com by filling out the registration form available via a link on the home page of the website during periods announced at the beginning of each semester. In the form, a link will provide access to the Chorus Dei Choir Manual, which must be read and understood, before ticking agreeing with the group's regulations contained therein. After the process of sending and receiving the form, there will be an analysis and a personal interview with the conductor, who will communicate the acceptance officially inviting him/her to participate in all proposed activities as a new member. The user must register on the site, providing his/her email address for login and creating his/her access password, and wait for the release of his/her access in the system, which will allow him/her free access to the functionalities on the site exclusively for members. This initial process can take anywhere from a few hours to eight days. After official entry into the group, the chorister/instrumentalist must receive communications from the group and respond by actively participating within what is proposed, throughout the semester period to which the signed plan refers.

Requirements to create an account on the site:
Although several pages of our website are freely accessible to the general public, to use their functionality restricted to Chorus Dei & Orquestra participants, you must be at least eight years of age and be an active member of the choir or orchestra, or have legal authority, as a representative of your child. You are not permitted to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
Main commercial terms offered to members:
By subscribing to a participating member plan, you agree that: (i) you are responsible for reading the complete item listing before committing to purchase it; (ii) you accept a legally binding contract to purchase one of the offered items when commit to signing a plan and you complete the checkout payment process.
The amounts stipulated for our participation/membership plans are listed on the website. Payments can be made by credit card, bank slip or PIX. We reserve the right to change the values of the plans and/or products shown at any time and correct pricing errors that may inadvertently occur. The fee for the services and any other charges you may incur in connection with the use of payment methods, such as taxes and possible transaction fees, will be charged according to your payment method.
Return and refund policy:
For any contribution such as a signed/purchased semester plan, you may request a refund of amounts proportional to the corresponding monthly fee whenever:
For whatever reason, no longer willing or able to be part of the group as a member of the choir. In this case, you must communicate your intention in writing to the email: contato@chorusdei.com , and have the gown with jabô duly returned and stored in the choir gown room at UNASP-HT, with the consent of the conductor. From the fulfillment of these conditions, the value of the semester corresponding to the time of official absence of the chorister will be calculated (counted from the 31st day from the date of communication of the email until the last day of validity of the referred semester paid) for the purpose of return to the choir member's bank account who opted to subscribe to a semiannual payment plan with a single payment by PIX.
In addition, please note the following: (i) Values for products/services may only be returned in the country in which they were originally purchased; and (ii) the following products are not eligible for return: donation to the Coral, donation to the Orchestra.
Retention of the right to change offers:
We may, without notice, change the services; stop providing the services or any features of the services we offer; or create limits for services. We may permanently or temporarily terminate or suspend access to the Services without notice and liability for any reason or no reason.
Warranties and liability for services and products:
Among the guarantees of services offered to the chorister, such as the provision of rehearsals and periodic performances, rehearsal kits and scores, providing the vocal-artistic development of the same, considering its natural characteristics and limitations, Chorus Dei reserves the right to suspend activities eventually every semester, whether due to vacations, holidays or any other necessary reason.
When we receive a valid warranty claim for a product purchased from our webshop on the website, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon prompt return of the product to us. We will pay for shipping repaired or replaced products to the customer and the customer will be responsible for returning the product to us.
Intellectual property, copyrights and logos :
The Service and all materials contained or transferred therein, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual property related to them are the exclusive property of Chorus Dei & Orquestra. Except as explicitly provided herein, nothing in these Terms shall be deemed a license in or under such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, perform publicly, publish, adapt, edit or create derivative works without permission from Chorus Dei & Orquestra, in the person of its director, David Wesley Silva, CPF 09367414811.
Right to suspend or cancel user account:
We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if, in our sole and exclusive determination, you violate any provision of these Terms or any applicable law or regulation. You may discontinue use and request cancellation of your account and/or any service at any time. Notwithstanding anything to the contrary with respect to automatically renewed subscriptions to paid services, such subscriptions will only be discontinued after the expiration of the respective period for which you have already paid.
Indemnity:
You agree to indemnify and hold Chorus Dei & Orquestra, in the person of its voluntarily serving chorus and orchestra director [David Wesley Silva] harmless from any claims, losses, liabilities, claims or expenses (including attorneys' fees) made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
Limitation of Liability :
To the fullest extent permitted by applicable law, in no event shall Chorus Dei & Orquestra or its volunteer director [David Wesley Silva] be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for lost profits, goodwill, use of data or other intangible losses arising out of or related to the use or inability to use the Service.
To the fullest extent permitted by applicable law, Chorus Dei & Orquestra assumes no responsibility for any errors (i), errors or inaccuracies of content; (ii) personal injury or property damage of any nature resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Right to change and modify the Terms:
We reserve the right to modify these terms from time to time in our sole discretion. Therefore, you should periodically review these pages. When we materially change the Terms, we will notify you. Your continued use of the Site or our service after any change constitutes your acceptance of the new Terms. If you do not agree with any of these terms or any future version of the Terms, please do not use or access (or continue to access) the website or service.

You agree to receive promotional messages and materials from time to time by post, email or any other contact form you may provide to us (including your phone number for calls or text messages). If you do not wish to receive these promotional materials or notices - please simply notify us at any time.
Law preference and dispute resolution:
These Terms, the rights and remedies provided herein, and any and all claims and disputes relating thereto and/or the Services, will be governed, interpreted and enforced in all respects solely and exclusively in accordance with the internal laws of the State of São Paulo. , Brazil, without respecting its conflicts of legal principles. Any and all claims and disputes will be presented, and you consent to them being decided exclusively by a court of competent jurisdiction located in Hortolândia-SP. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
